1. Acceptance of Fair Use Policy
This Fair Use Policy (the “Policy”) applies to all persons and entities (collectively, “Customers”) using National Transport Authority’s GTFS Real Time Services. This Policy is designed to protect the security, integrity, reliability and privacy of the GTFS Real Time Services to its Customers (the “Services”). National Transport Authority reserves the right to modify this Policy from time to time, effective immediately upon posting of the modification.
Your use of National Transport Authority’s Services constitutes your acceptance of the Policy in effect at the time of your use. If you do not accept the terms of this Policy, you must not use any National Transport Authority’s systems and Services.
National Transport Authority supports the free flow of information and ideas over the Internet and does not actively monitor use of the websites and National Transport Authority systems under normal circumstances. However, National Transport Authority seeks to balance this aim with National Transport Authority obligations to other users, third parties and at law. National Transport Authority does therefore maintain identifiable Logs to ascertain compliance with this Policy.
You are solely responsible for any and all acts and omissions that occur during or related to your use of the Services, and you agree not to engage in any unacceptable use of the Services. Additional terms and conditions apply when you enter into any contract with National Transport Authority for National Transport Authority services and these terms of use and this Policy is incorporated into such agreements by reference.
2. Fair Usage Limits
Fair usage amounts refer to total number of GTFS Real Time requests within the stated time frame. Usage amounts are per day, and are not transferable from day to day or month to month
You will be issued a Unique Token ( the “Token”) that will be required for each access request. This Token is non-transferable and all activity will be attributed to the Authorised assignee.
The number of requests will be restricted to your usage limit.
Usage limits are configurable and will default to 5,000 / day.
National Transport Authority may at its discretion alter the usage limit of Customers
3. Prohibited Uses
Unacceptable use includes, but is not limited, to any of the following:
Illegal Activity – Services shall at all times be used in compliance with all applicable laws.
Installation or distribution of “pirated” or other software products that are appropriately licensed for use by the Customers.
Deceptive marketing practices.
Actions that restrict or inhibit anyone.
Introduction of malicious programmes into National Transport Authority’s network or servers or other products and services of National Transport Authority (i.e. viruses, trojan horses or other harmful programmes).
Causing or attempting to cause security breaches or disruptions.
Executing any form of network monitoring that will intercept data not intended for the Customers.
Circumventing user authentication or security of any host, network or account.
Use of the websites, National Transport Authority systems or services to conduct any fraudulent activity including, without limitation, any “pyramid scheme”, “ponzi scheme” or “chain letter.
Harassment, whether through language, frequency or size of messages.
Any other inappropriate activity or abuse of the Services (as determined by National Transport Authority at its sole discretion).
The GTSF-Real Time service is not intended to be used for mass gathering of Real time information, whist there is a daily allowance of 5,000 requests per day, these should be largely trending with peak and off peak commuting / travel patterns and not concentrated on a short time frame in a particular geographic area. The NTA may withdraw the service to a token if there is evidence that GFTS – Real-Time is being used for mass data acquisition.
Failure or delay in exercising or enforcing this Policy shall constitute a waiver of the Policy or of any other right or remedy. If any provision of this Policy is deemed unenforceable due to law or change in law, such a provision shall be disregarded and the balance of the Policy shall remain in effect.
4. Enforcement
4.1. National Transport Authority may take any or all of the following action at its discretion. National Transport Authority will determine what action is appropriate to be taken against a us on a case by case basis.
4.1.1. Issue verbal or written warnings and take such further action as National Transport Authority deems appropriate if such warnings are not heeded;
4.1.2. Suspend or terminate access to any or all of the websites or National Transport Authority’s systems and services without notice at any time;
4.1.3. Inform the appropriate authorities and provide them with information regarding any suspected illegal activity; or
4.1.4. Bring legal action in relation to any breach by users of this Policy or any illegal or suspected illegal activity.
4.2. You accept that we may apply limits to your use of any service, which we provide. We may do this on various grounds including, without limitation, any use of the services by you, which is inappropriate or unfair or affects (or may affect) other users’ enjoyment of the service or is significantly different from the usage that we would expect from a typical consumer/business user as applicable.
4.3. Your breach of this Policy may also give rise to termination of or further action under any other contract that you may have with National Transport Authority that incorporates this Policy.
4.4. You acknowledge that National Transport Authority may be required by law or regulation to access, monitor, store or copy material sent by you or to you or other users without further notice.
4.6. You agree to compensate us for any loss or damage that may be caused to National Transport Authority (including reasonable legal costs) as a consequence of your breach of this Policy.
